Terms of Service

Remember When ("we", "us", "our") is currently operated by Andreas Maos ("the operator"), an individual based in the United Kingdom, pending incorporation of a formal legal entity. These Terms of Service ("Terms") govern your access to and use of the Remember When website and application (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Our Privacy Policy explains how we collect and use your data and is incorporated into these Terms by reference.

1. What Remember When is

Remember When is a private, shared memory book. Users create "moments" — a name, an optional date, location, and tags — and invite specific other people to contribute posts (text, photos, videos, and voice recordings) to that moment. Moments are never public. There is no public feed, no likes, no follower counts, and no algorithmic recommendation of your content to strangers.

2. Eligibility and accounts

  • You must be at least 13 years old to create an account, and you must also meet the minimum age required in your own country to consent to use of an online service without parental permission (this is higher than 13 in some countries — e.g. up to 16 in parts of the EU). If you are under 18, you should have a parent or guardian's permission to use the Service.
  • You must provide accurate sign-up information (first name, last name, email, username, password) and keep your login credentials confidential. You're responsible for all activity that happens under your account.
  • One person, one account. You may not create an account on behalf of someone else without their knowledge, except where our invite features (Section 5) are explicitly designed to let you invite others.
  • We may suspend or terminate accounts that violate these Terms, are inactive for an extended period, or where we reasonably believe the account is being used fraudulently or to harm others.

3. Moments, roles, and permissions

Content in Remember When lives inside "moments," and every person on a moment has one of three roles. These roles determine what a person can do — not who owns the underlying content (see Section 4).

  • Owner — the person who created the moment (or who ownership has since been transferred to). Owners have full control: they can edit the moment's details, manage every member's role, remove members, invite new editors or readers, transfer ownership to an editor, and — if they choose to leave — either hand off ownership first or delete the moment for everyone.
  • Editor — can post to the moment, edit the moment's details and tags, invite and remove readers, and delete any post in the moment (their own or someone else's). Editors cannot remove other editors or the owner, and cannot transfer ownership.
  • Reader — view-only access. Readers can see the moment's posts and media but cannot post, edit, or manage membership. Readers are invited by the owner or any editor, or can join via a time-limited shareable link.

Roles can change over time (e.g., a reader promoted to editor), and role changes, removals, and ownership transfers trigger a notification to the people affected.

4. Your content, and what happens to it when it's shared

  • You own what you create. You retain ownership of the posts, photos, videos, voice recordings, and other content you upload ("User Content").
  • License to us. By posting User Content, you grant us a limited, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating the Service — i.e., showing it to you and to the specific people you've shared the relevant moment with. We do not use your content to train AI models, sell it, or license it to third parties, and we do not display it publicly.
  • License to other moment members. When you post into a shared moment, you're granting the other current members of that moment (per their role) the ability to view it, and — if they're an editor — to delete it, for as long as they remain a member and the moment exists. This is what makes shared moments work; if you're not comfortable with an editor being able to remove your post, don't post to a moment they edit.
  • What happens if you leave a moment. When you leave a moment (or are removed), you choose whether your existing posts stay in the moment (attributed to you) or are deleted.
  • What happens if you delete your account. Deleting your account is permanent and deletes every post you've ever authored, across every moment — including moments owned by other people. It does not leave your posts behind, attributed to you. If you own a moment that's shared with anyone else (i.e. it has at least one other member who has accepted membership), you cannot delete your account until you transfer ownership of that moment to another member, or delete the moment yourself. This is required specifically so that deleting your own account can never silently destroy a moment — or the posts and media within it — that belongs to other people too. Moments you own with nobody else on them are deleted along with your account. See our Privacy Policy for full detail.
  • What happens if a moment is deleted. An owner can delete an entire moment (this happens automatically for solely-owned moments when the owner deletes their account, or manually in-app, generally when no editor exists to transfer ownership to). This is permanent, deletes all posts and media in the moment, and notifies every member.

5. Inviting others

You can invite people to a moment by username, email, or a shareable link.

  • If you invite someone by email and they don't have an account, we'll email them an invitation to sign up. Their email address is used only to facilitate that invitation and is not shared with other users.
  • Shareable reader links let you invite people without knowing their username or email in advance. Only one link is active per moment at a time, and you (or any editor/owner) can set it to expire or revoke it early. Anyone who joins via a valid link before it's revoked keeps their access even after the link itself is invalidated.
  • You're responsible for who you invite. Don't share invite links publicly or send them to people who wouldn't want to be invited.

6. Acceptable use

You agree not to use the Service to:

  • Upload content that is unlawful, harassing, defamatory, or that infringes someone else's intellectual property or privacy rights;
  • Upload content depicting a minor in a way that is exploitative or inappropriate;
  • Impersonate another person, or invite/tag real people without a reasonable basis for believing they'd consent to being included in that moment;
  • Attempt to gain unauthorized access to another user's account, moment, or data, or to circumvent the role/permission system described in Section 3;
  • Use automated means (scraping, bots) to access the Service outside of its intended use;
  • Interfere with or disrupt the Service, including attempting to bypass rate limiting or security controls.

We may remove content or suspend accounts that violate this section. Because moments are private, we generally rely on user reports rather than proactive monitoring — see Section 7.

7. Reporting and moderation

If someone shares a moment with you and posts something that violates these Terms, you can leave the moment and/or contact us at andreasmaos@gmail.com to report it. Because we don't access private moment content as a matter of course (see our Privacy Policy's security section), our ability to act on a report depends on what you're able to describe or show us, or, where necessary, limited internal access to investigate the specific report.

8. Paid plans

Remember When is currently free to use, with a placeholder pricing page indicating a possible future paid tier. No payment is currently collected. If and when paid plans launch, we'll update these Terms with billing, refund, and cancellation terms, and give existing users advance notice before anything they're currently using becomes paid.

9. Termination

  • By you: you can delete your account at any time from Account → Danger zone, by typing your username to confirm. This permanently removes your personal data and every post you've authored anywhere on the Service. If you own a moment shared with others, you'll need to transfer ownership of it first — see Section 4.
  • By us: we may suspend or terminate your account for violating these Terms, extended inactivity, or if we discontinue the Service. Where practical, we'll give notice first.

10. Disclaimers and limitation of liability

The Service is provided "as is." We do our best to keep it available and your data safe, but we don't guarantee uninterrupted access, and we're not liable for indirect, incidental, or consequential damages arising from your use of the Service, to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be excluded under UK law (e.g., for death, personal injury caused by negligence, or fraud).

You are responsible for keeping your own backups of anything irreplaceable. While we take reasonable steps to prevent data loss, Remember When is an early-stage product and we cannot guarantee against all possible loss.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify users in-app or by email before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

Remember When is intended for a worldwide user base, but the Service is operated from the United Kingdom, and these Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales. (If the operator or a future incorporated entity is based elsewhere in the UK, this section should be updated to Scotland or Northern Ireland accordingly.)

If you live somewhere that gives you consumer protection rights that can't be waived by contract (for example, certain EU, UK, or US state laws), nothing in this section removes those rights — this clause governs everything else.
